Clients will often call and describe how they had a green light, made a left-hand turn, and were struck by a driver in the intersection. More likely than not, the insurance company is going to deny that claim, because you had a duty to yield to them.
There are ways to overcome that. If they had plenty of time to see you or were speeding, you might have a claim. You will see that a lot where somebody hits the front of your car, as opposed to the back of the car. If you were just getting in the intersection, they are probably going to hit the front of your car. You are probably more likely at fault than they are.
If they hit you in the very back-rear of your car, it is more likely than not they were not paying attention. However, expect the insurance company from the start to say you failed to yield and deny your claim for your car accident injury. It is in their best interest to do so, as, like other businesses, they are looking to make money.
