You should not have to carry this heavy burden alone. At 612-Injured (Heimerl & Lammers), we help everyday Minnesotans pick up the pieces after a serious injury. We treat you like a trusted neighbor, but we fight for you like a shield. Our Minneapolis personal injury lawyers are here to take the stress off your shoulders so you can focus entirely on getting better.

3 Critical Mistakes That Can Ruin Your Minnesota Injury Claim

The days and weeks immediately following an accident are critical. Insurance adjusters know you are stressed, and they often use this time to catch you off guard. To protect your rights and your future financial recovery, be sure to avoid these three common mistakes:

  • Giving a Recorded Statement: The insurance adjuster representing the person who hit you may call and sound very friendly. They will ask to record a statement “just to get the facts straight.” Do not do this. They are trained to phrase questions in ways that make you look at fault or make your injuries seem less severe.
  • Delaying Medical Care: Even if you think your injuries are minor, see a doctor right away. Conditions like whiplash, internal bruising, or concussions from a bad fall or car crash can take days to fully show symptoms. If you wait weeks to go to a clinic, the insurance company will argue that you were not actually hurt in the accident.
  • Posting on Social Media: It is natural to want to update friends and family on Facebook or Instagram after a scary event. However, insurance investigators constantly monitor these platforms. A simple photo of you smiling at a family dinner can be twisted by their legal team to claim that you are perfectly fine and not experiencing pain.

Navigating Minnesota’s No-Fault Insurance Trap & The $4,000 Tort Threshold

Minnesota operates under a strict No-Fault automobile insurance system (Minnesota Statutes § 65B.51). This means that after an accident in Minneapolis, your own insurance policy’s Personal Injury Protection (PIP) is legally required to cover your immediate economic losses, up to $20,000 for medical expenses and $20,000 for lost wages, regardless of who caused the crash.

However, PIP policy limits are quickly exhausted in cases involving severe injuries, such as traumatic brain injuries (TBI) or complex fractures. To step outside of the No-Fault system and file a third-party liability claim or lawsuit against the at-fault driver for pain, suffering, and non-economic damages, your case must meet at least one of Minnesota’s strict statutory tort thresholds:

  • Medical Expense Threshold: Your necessary medical treatments must exceed $4,000 (excluding diagnostic X-rays or MRIs used solely for evaluation).
  • Disability Threshold: You must suffer an inability to engage in substantially all of your usual and customary daily activities for a period of no less than 60 days.
  • Permanency Threshold: The injury must result in a permanent injury, permanent disfigurement, or death.

Our legal team aggressively documents your medical journey from day one, tracking every line item of your bills to ensure your case legally satisfies these thresholds, forcing corporate insurance adjusters to respect the true value of your claim.

The Reality of Insurance Companies

It is important to understand one major truth: insurance companies are not your friendly neighbors. They are large corporations focused on saving money. Their main goal is to pay you as little as possible, or even deny your claim completely.

The Insurance Playbook: They might call you right after an accident, acting helpful, to get you to sign a quick settlement. Don’t fall for it. That initial offer is almost always lower than what you actually need to cover your long-term medical care and lost wages.

We know their playbook inside and out. When you hire us, we step between you and the insurance company. We handle all the phone calls, the paperwork, and the negotiations so you can have peace of mind.

Why Our Minneapolis Personal Injury Clients Trust Our Legal Team

With years of dedicated practice in the Twin Cities, we’ve helped hundreds of families navigate the complexities after an accident at the hand of someone else’s negligence. Here is what they have to say.

Real Results From Twin Cities Roadways

Review our work and learn why so many injured people across Minnesota trust our attorneys to fight for meaningful results.

$340,000 Recovery

Commercial Fleet Collision near Downtown Minneapolis

Our client was traveling southbound on Hennepin Avenue near the South 11th Street intersection when a commercial delivery van failed to yield the right-of-way, causing a severe T-bone collision. The defense attempted to minimize the claim by citing the client’s pre-existing lumbar degenerative disc disease. By subpeonaing the fleet vehicle’s black box telematics data to prove excessive speed and leveraging a localized medical expert to demonstrate the acute aggravation of the spinal injury, we cleared the $4,000 Minnesota tort threshold and secured a policy-limits settlement prior to filing a formal complaint in the Hennepin County 4th Judicial District Court.

$185,000 Settlement

Pedestrian Strike in the North Loop

A commuter was walking within a marked crosswalk near Washington Ave N and 3rd Ave N when an distracted driver turning left struck them, resulting in a fractured tibia and a severe concussion. The insurer argued comparative fault, claiming the pedestrian was distracted by their mobile device. We secured local commercial security footage from surrounding North Loop establishments to definitively prove the driver’s complete line-of-sight failure, establishing 100% liability and forcing a payout that fully covered the client’s out-of-pocket medical debt at Hennepin Healthcare.

Personal Injury FAQ’s

Most Minneapolis personal injury firms work on a contingency fee basis. This means you pay $0 upfront. The attorney only gets paid if they successfully recover money for you through a settlement or court verdict.

  • Typical Fee: Usually 33.3% (one-third) of the final settlement. This may increase to 40% if the case goes to trial.
  • Costs: Ask if the firm covers "litigation costs" (like filing fees and medical records) upfront. Most reputable firms do, and they only recoup those costs if you win.

Minnesota has a relatively generous Statute of Limitations, but it varies by the type of accident:

  • General Negligence (Car Accidents/Slip and Fall): 6 years from the date of the injury.
  • Medical Malpractice: 4 years from the date of the error.
  • Wrongful Death: 3 years from the date of death.
  • Government Claims: If you are suing a city or the state, you must often file a formal "Notice of Claim" within 180 days.

Minnesota is a No-Fault state, which confuses many people. Regardless of who caused a car accident, your own insurance pays for your first $20,000 in medical expenses and $20,000 in lost wages.

To sue the other driver for additional damages (like pain and suffering), you must meet one of these "thresholds":

  • More than $4,000 in reasonable medical expenses
  • A disability lasting 60 days or more
  • Permanent injury or disfigurement

An attorney cannot give you an exact number immediately, but they calculate value based on two categories of "damages":

  • Economic Damages: Quantifiable costs like hospital bills, physical therapy, and lost income (current and future).
  • Non-Economic Damages: Less tangible impacts like pain and suffering, emotional distress, and "loss of consortium" (impact on your relationship with a spouse).
  • Comparative Fault: Minnesota follows a 51% rule. You can still recover money as long as you were 50% or less at fault, but your payout will be reduced by your percentage of blame.

Minnesota follows a modified comparative fault rule (Minnesota Statutes § 604.01). You can still recover financial compensation as long as your fault is not greater than the fault of the other party (50% or less). However, your final financial recovery will be reduced by your exact percentage of assigned fault. For example, if a jury awards $100,000 in damages but finds you 20% at fault for the collision, your final recovery will be $80,000.
