I wrote in another post about why your insurance company has to pay when you get into an accident, but we did not talk about who is supposed to pay. Most of the time, your own insurance company will be the one covering. If you are named as an insured on a policy, that is the insurance company that is going to have to pay.
In many cases, especially for children, those injured in an accident do not have insurance and are not required to have it, so the second priority is going to be a relative with whom they live. If that person has insurance and is a blood relative or related by marriage, you can get benefits there.
The third scenario is going to be if neither of those first situations apply to you and you are in a car that is insured, you can get the benefits through that car.
Lastly, if you do not have any of those and you are not required to have your own insurance, you can get it through the Assigned Claims Bureau. We will discuss that in a different post.
If you do not have insurance and you own a car, you are not going to get those benefits. You might be able to recover from an at-fault driver to take care of your bills, but otherwise, you are just not going to be entitled to those benefits.
