With personal injury claims, when there is a car accident where someone is negligent for example, is one of the times when an attorney will do a contingency fee, which means we don’t get paid unless we recover something for you. A lot of times, the market rate is going to be about 1/3’rd or 33.33% for claims that can settle, but if they go to a jury trial that often gets bumped up to something higher, usually around 40%.
What that means practically for you is if you have a $10,000 settlement, an attorney, for their fees, is going to get $3,333 on a $10,000 settlement. If they paid money for medical records or your bills and they paid another $100, they would get that reimbursed, as well.
Now, from your portion, you would get the other 2/3’rds less whatever those case costs are, so that is how a contingency fee would work. When we do not make a recovery, the attorney will typically absorb those costs, and they do not get paid.
