Fall and winter are around the corner for us, and as we get towards wet slippery leaves, snow and ice, we want to think about how might those impact fault when there is a car accident here in Minnesota.
Consider a scenario where you are going down an icy hill. At the bottom of this hill is a car waiting at a stop sign, and you were coming down the hill, pressing your brakes, and unable to stop. When your claim is examined, they are going to say that you are probably still going to be at fault, even though the snow and ice contributed to it.
They will question whether you could have driven in a different manner to avoid that. Maybe, you were going too fast for the conditions, which is a vague term to say that if you have been going slightly slower than what you were, this may not have happened. Another alternative is that you could have veered off the road to avoid the damage.
So, as far as fault goes, the road conditions might have contributed to the accident, but they are still going to make the at-fault driver own it.
