Well, it all depends, because there are different categories of drivers. You have your independent drivers, who have their own company, but maybe lease a truck from someone else. Or you have an independent owner-operator. They are the only people and contract with different organizations to pick it up the product and move it. Or you can have somebody who is an employee of the company.
If it is an employee, it is easier. You are going to go after both the driver and the company that hired them.
If it is an independent owner-operator, you are probably just going after the truck driver. You are not going to be able to go after the company who contracted them.
It is the same for someone who is leasing a truck, unless the company that leased it to them knew the driver was a habitual drunk driver and leased it to him anyway. You are probably going to be stuck just bringing a claim against the individual driver.
