After a car accident, you have the three different claims that you can bring, assuming you are not at fault: property damage no-fault insurance claim, and the liability claim against the at-fault driver. The property damage claim is separate from those other two claims.

Each one has their own rules. You are able to settle the property damage claim early on with the at-fault driver’s insurance, and it does not have an impact on your ability later to also settle the liability claim for your injuries. Those are going to be two completely separate claims that you are bringing.

One point of which you should be aware is if you go after the property damage claim and the other side does not admit that they are at fault, you have to sue them. Even if you are just bringing it in small claims court or conciliation court, you are required to bring all of your claims at once, regardless if you have finished treatment or not. Otherwise, you are not going to be able to bring the liability claim later, so keep that in mind if you are trying to take care of your property damage quickly.
