Sometimes, in personal injury, there are situations that can result in conflicts of interest. The most common one involves a driver and passenger in an auto accident. Sometimes, an attorney is unable take on both of those claims.

A good example would be if a driver is making a left-hand turn, but the other person is speeding into the intersection. There is a question about who is more at fault, but the passenger does not have that question. They are innocent. They did not do anything, so they have a claim against both drivers.

The driver cannot have the same attorney as the passenger, because they have a direct conflict with the passenger. The passenger is seeking money from both parties, and the attorney of the driver with which the passenger was riding is going to have inside information about what happened if they represent both. This is not allowed. That is an unwaivable conflict of interest.
