3 Critical Mistakes That Can Ruin Your Minnesota Injury Claim

The days and weeks immediately following an accident are critical. Insurance adjusters know you are stressed, and they often use this time to catch you off guard. To protect your rights and your future financial recovery, be sure to avoid these three common mistakes:

  • Giving a Recorded Statement: The insurance adjuster representing the person who hit you may call and sound very friendly. They will ask to record a statement “just to get the facts straight.” Do not do this. They are trained to phrase questions in ways that make you look at fault or make your injuries seem less severe.
  • Delaying Medical Care: Even if you think your injuries are minor, see a doctor right away. Conditions like whiplash, internal bruising, or concussions from a bad fall or car crash can take days to fully show symptoms. If you wait weeks to go to a clinic, the insurance company will argue that you were not actually hurt in the accident.
  • Posting on Social Media: It is natural to want to update friends and family on Facebook or Instagram after a scary event. However, insurance investigators constantly monitor these platforms. A simple photo of you smiling at a family dinner can be twisted by their legal team to claim that you are perfectly fine and not experiencing pain.

How Minnesota’s “No-Fault” and “Comparative Fault” Laws Affect You

Minnesota has unique insurance laws that confuse many people. Understanding these two rules will give you a much clearer picture of how your medical bills get paid and how your final settlement is calculated:

1. Minnesota is a “No-Fault” State

If you are hurt in a car crash, your own auto insurance company is required by law to pay for your initial medical treatment and lost wages, no matter who caused the accident. This is called Personal Injury Protection (PIP). It does not mean nobody is at fault for the crash; it just means your own insurance handles the immediate, basic bills so you can get fast medical care.

2. The 51% Comparative Fault Rule

Can you still get compensation if you were partly to blame for the accident? In Minnesota, the answer is yes, as long as you were not 51% or more at fault. State law allows you to collect compensation from the other driver, but your total payout will be reduced by your percentage of blame.

How it works: If a jury decides your total damages are $100,000, but finds that you were 20% to blame for the crash (perhaps because you were speeding slightly), your final payout will be reduced by 20%, leaving you with $80,000. Because the insurance company will try to shift as much blame onto you as possible to save money, having a strong shield to protect your side of the story is vital.

The Reality of Insurance Companies

It is important to understand one major truth: insurance companies are not your friendly neighbors. They are large corporations focused on saving money. Their main goal is to pay you as little as possible, or even deny your claim completely.

The Insurance Playbook: They might call you right after an accident, acting helpful, to get you to sign a quick settlement. Don’t fall for it. That initial offer is almost always lower than what you actually need to cover your long-term medical care and lost wages.

We know their playbook inside and out. When you hire us, we step between you and the insurance company. We handle all the phone calls, the paperwork, and the negotiations so you can have peace of mind.

Personal Injury FAQ’s

Most Minneapolis personal injury firms work on a contingency fee basis. This means you pay $0 upfront. The attorney only gets paid if they successfully recover money for you through a settlement or court verdict.

  • Typical Fee: Usually 33.3% (one-third) of the final settlement. This may increase to 40% if the case goes to trial.
  • Costs: Ask if the firm covers "litigation costs" (like filing fees and medical records) upfront. Most reputable firms do, and they only recoup those costs if you win.

Minnesota has a relatively generous Statute of Limitations, but it varies by the type of accident:

  • General Negligence (Car Accidents/Slip and Fall): 6 years from the date of the injury.
  • Medical Malpractice: 4 years from the date of the error.
  • Wrongful Death: 3 years from the date of death.
  • Government Claims: If you are suing a city or the state, you must often file a formal "Notice of Claim" within 180 days.

Minnesota is a No-Fault state, which confuses many people. Regardless of who caused a car accident, your own insurance pays for your first $20,000 in medical expenses and $20,000 in lost wages.

To sue the other driver for additional damages (like pain and suffering), you must meet one of these "thresholds":

  • More than $4,000 in reasonable medical expenses
  • A disability lasting 60 days or more
  • Permanent injury or disfigurement

An attorney cannot give you an exact number immediately, but they calculate value based on two categories of "damages":

  • Economic Damages: Quantifiable costs like hospital bills, physical therapy, and lost income (current and future).
  • Non-Economic Damages: Less tangible impacts like pain and suffering, emotional distress, and "loss of consortium" (impact on your relationship with a spouse).
  • Comparative Fault: Minnesota follows a 51% rule. You can still recover money as long as you were 50% or less at fault, but your payout will be reduced by your percentage of blame.
