In part 3 of our series on reasons why the at-fault driver’s insurance company might decide to deny your claim, we are addressing inactive insurance. One of the more frustrating ones is they claim that the other driver didn’t have insurance coverage at the time of the car accident. So, you get into an accident. They set up a claim. The police came out. You exchange insurance information. A week later, though, you get a denial letter saying that they are not covering the accident.
Many other times, we see situations where either the policy had expired and the person did not renew it, or they come up with unique ways to say that the person did not have coverage, maybe even just for that day. So, if the insurance was supposed to renew on the first of the month, the accident happened on the second, and they did not get payment until the third, they might deny coverage saying the policy was not active that day.
I would not just roll over and accept that your insurance company is going to have to pay uninsured motorist coverage for it. You will want to dig into that and see if they did actually notify people. Maybe there was an auto-pay that got messed up along the way, but do not just assume that because the other person’s insurance is saying, there is no coverage that this is actually the case.
